Atlas Alert operates this store and website, together with related information, content, features, tools, products, mobile applications, cameras, subscriptions, and services (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide ecommerce services to you.

This Privacy Policy describes how Atlas Alert collects, uses, processes, and discloses personal information when you visit, use, purchase from, or otherwise interact with the Services, including when you communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy regarding the collection, processing, or disclosure of personal information, this Privacy Policy controls.

• Usage information: information about how and when you access, navigate, and interact with the Services.
• Camera and service information: information necessary to operate Atlas Alert cameras and app features, including camera status, configuration, connectivity, alert preferences, horse-related profile information, and events or observations generated through the Services.

Sources of Personal Information

We may collect personal information from the following sources:

• Directly from you when you create an account, make a purchase, use the Services, configure a camera or horse profile, communicate with us, or otherwise provide information.
• Automatically through the Services, including from your browser, mobile device, camera, network, cookies, pixels, software development kits, and similar technologies.
• From service providers that provide technology, payment processing, cloud storage, messaging, analytics, customer support, fulfillment, shipping, fraud prevention, or other services on our behalf.
• From business partners, marketing partners, social-media platforms, or other third parties, where permitted by law.

Depending on how you interact with Atlas Alert or which Services you use, we may use personal information for the following purposes:

• Provide, tailor, and improve the Services. We use personal information to perform our contract with you, process payments, fulfill and ship orders, activate and manage subscriptions, provide camera and app functionality, remember preferences, send account or service notifications, process returns and exchanges, manage accounts, provide reviews and recommendations, improve product performance, and customize your experience.
• Operate horse health and safety features. We may process information generated through Atlas Alert cameras, account settings, horse profiles, and alert preferences to provide monitoring, analytics, notifications, and other features you enable.
• Marketing and advertising. We may use personal information to send marketing or promotional communications by email, text message, or other channels when permitted, and to show advertisements or measure campaign performance. You may opt out of marketing communications as described below.
• Security and fraud prevention. We may authenticate users, secure payments and accounts, detect, investigate, or respond to suspected fraudulent, illegal, unsafe, or malicious activity, protect public safety, and secure the Services.
• Communicating with you. We use personal information to provide customer support, answer inquiries, provide updates, and maintain our business relationship with you.
• Legal and operational reasons. We may use personal information to comply with law, respond to valid legal process, investigate disputes, participate in litigation or civil discovery, enforce our terms and policies, protect our rights, and complete business transactions.

SMS Text-Message Alerts

Atlas Alert offers optional SMS text-message alerts relating to horse health and safety events. This section explains how Atlas Alert handles information associated with that program.

Direct consent to Atlas Alert. When you turn on the SMS option inside the Atlas Alert mobile application, you provide consent directly to Atlas Alert to send automated alerts concerning the horse or profile for which SMS is enabled. Consent to receive SMS alerts is not a condition of purchasing Atlas Alert hardware or services.

Information collected for SMS. We may collect and store the mobile number entered as a primary or secondary contact for a horse, the fact that SMS was enabled, the date and time of opt-in, the date and time of any later opt-out, and replies such as STOP or HELP used to administer the program.

How SMS information is used. Numbers submitted for horse-alert SMS messages are used to deliver the alerts requested through the Atlas Alert app, administer the SMS program, provide support, and comply with legal obligations. These numbers are not used for unrelated cross-selling, upselling, or promotional messaging unless separate consent has been obtained.

No sharing for third-party marketing. Atlas Alert does not sell, rent, share, disclose, or transfer mobile numbers or SMS opt-in information to third parties or affiliates for their own marketing or promotional purposes. We may disclose this information to messaging carriers, aggregators, telecommunications providers, and service providers that deliver messages on our behalf, solely as needed to provide the SMS service.

Opt-out and help. You may opt out at any time by replying STOP to an Atlas Alert SMS, turning the applicable SMS setting off inside the Atlas Alert app, or contacting info@atlasalert.ai. You may reply HELP for assistance. Message and data rates may apply. Message frequency varies depending on enabled features and detected events.

Retention. After an SMS opt-out, Atlas Alert may retain the telephone number and opt-out record for the period necessary to honor the request and comply with law, typically for at least twelve months, after which the number may be deleted or de-identified from the SMS channel unless continued retention is required.

Relationship With Shopify

The online store is hosted by Shopify. Shopify collects and processes personal information relating to your access to and use of the store so that it can provide and improve ecommerce services. Information submitted through the store may be transmitted to Shopify and other service providers, including providers located outside the country where you live.

Shopify may also use information from your interactions with our store and other Shopify merchants to provide enhanced services, security, analytics, and personalized advertising features. In those circumstances, Shopify may be independently responsible for certain processing activities. Children's Data

The Services are not intended for children, and Atlas Alert does not knowingly collect personal information from children under the age of majority in their jurisdiction. A parent or guardian who believes a child has provided personal information may contact us to request deletion.

Atlas Alert does not have actual knowledge that it sells or shares, as those terms are defined by applicable law, the personal information of individuals under sixteen years of age.

Security and Retention

Atlas Alert uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.

We retain personal information for as long as reasonably necessary to maintain accounts, provide the Services, fulfill transactions, support customers, honor preferences and opt-outs, comply with legal obligations, resolve disputes, prevent fraud, enforce agreements, and protect our rights.

Your Rights and Choices

Depending on where you live, you may have some or all of the following rights. These rights are not absolute and may apply only in certain circumstances:
